TERMS AND CONDITIONS OF SERVICE

Introduction

These Terms and Conditions ("Terms and Conditions") govern your use of STM Fitness Enterprises, LLC, doing business as sySTM Fitness ("sySTM Fitness," "we," "us," or "our") services, including personal training, partner training, group training, and online workout programs. By engaging sySTM Fitness's services, you agree to be bound by these Terms and Conditions.

Services

sySTM Fitness provides health and wellness coaching, including guided workout sessions with a fitness professional, nutrition guidance, habit tracking, and more. sySTM Fitness also offers online workout programs for more independent athletes. sySTM Fitness reserves the right to accept, decline, and terminate clientele at its sole discretion.

Payment

Payments can be made via cash, check, or card. sySTM Fitness uses Stripe to accept online card payments. Payments are due prior to engaging any services. Prices may be subject to change without notice.

Cancellation and Rescheduling

Clients may cancel sessions up to 24 hours in advance without penalty. If a client cancels inside of the 24-hour window, they must reschedule their session to be completed before the end of the month. If they are unable to reschedule to another day within that payment cycle, they may be charged for their missed session. If sySTM Fitness must cancel a session for any reason, clients will be given the opportunity to reschedule at no additional cost.

Liability Limitations

sySTM Fitness is not responsible for any injuries or damages that occur during or after the use of sySTM Fitness services. Clients engage with sySTM Fitness's services at their own risk, and sySTM Fitness is not liable for any harm or injury that may result. sySTM Fitness reserves the right to require clients to obtain medical clearance from a physician prior to engaging in any of sySTM Fitness's services.

Privacy Policy

sySTM Fitness is committed to protecting the privacy of its clients. sySTM Fitness collects personal information, including name, email address, phone number, and payment information, for the purpose of providing its services. sySTM Fitness will not sell, share, or rent any personal information to third parties without the client's consent, except as required by law. sySTM Fitness uses reasonable security measures to protect client data from unauthorized access, disclosure, or destruction.

Data Policy

sySTM Fitness collects data from its clients, including workout logs, nutrition logs, and other habit tracking data, for the purpose of providing its services. sySTM Fitness uses this data to personalize and improve its services. sySTM Fitness will not sell, share, or rent any client data to third parties without the client's consent, except as required by law. sySTM Fitness uses reasonable security measures to protect client data from unauthorized access, disclosure, or destruction.

Release of Liability and Assumption of Risk

Clients hereby acknowledge that they have voluntarily chosen to engage in the use of sySTM Fitness's services and acknowledge that such use may involve an inherent risk of injury or harm. Clients assume all risk of injury or harm and hereby release sySTM Fitness and its employees, agents, contractors, and representatives from any and all liability, including but not limited to liability for personal injury, property damage, or wrongful death.

User Conduct

As a user of sySTM Fitness's services, you agree to use the services in accordance with all applicable laws and regulations. You agree not to use the services for any unlawful, fraudulent, or abusive purposes, or for the transmission of any material that is prohibited by law, infringes upon the intellectual property rights of others, or is otherwise objectionable to sySTM Fitness. You also agree not to interfere with the normal operation of the services, including by introducing viruses, malware, or other harmful code. Any violation of these terms may result in the termination of your access to sySTM Fitness's services..

Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, without giving effect to its conflict of laws principles. Any legal action or proceeding arising out of or related to these Terms and Conditions or your use of the services shall be brought exclusively in the federal or state courts located in Fairfax County, Virginia and you hereby consent to the personal jurisdiction and venue of such courts.

Entire Agreement

These Terms and Conditions constitute the entire agreement between you and sySTM Fitness regarding the use of the services, and supersede all prior or contemporaneous communications and proposals, whether oral or written, between you and sySTM Fitness.

Amendments

sySTM Fitness reserves the right to modify or update these Terms and Conditions at any time, without prior notice. Your continued use of the services after any such modifications or updates shall constitute your acceptance of the revised Terms and Conditions.
